TERMS OF USE

Effective from: 03.11.2026

Avatud OÜ (registry code 12443197, address Harju county, Tallinn, Kesklinna district, Viru väljak 2, 10111, e-mail hello@avatud.ee)

1. GENERAL PROVISIONS AND DEFINITIONS

1.1. These Terms of Use (the Terms) govern the use of the web platform avatud.ee (the Platform) operated by Avatud OÜ (Avatud).

1.2. The Terms apply to everyone who browses the Platform, creates an account, books services or offers services (the User). A User who offers services is a Service Provider; a User who books services is a Client. The Service Provider Agreement and the list of prohibited services additionally apply to Service Providers.

1.3. The Platform is an intermediary environment that brings Service Providers and Clients together. Avatud does not itself provide the services offered on the Platform. Avatud's own services are the Platform's technical services: the account, search, booking and payment tools, and the paid plan for Service Providers.

1.4. Agency relationship: Avatud acts as the commercial agent of the Service Provider (Law of Obligations Act, VÕS § 670). The Service Provider has authorised Avatud to conclude service contracts with Clients and to receive Clients' payments on the Service Provider's behalf and account.

1.5. The Platform can also be reached through artificial intelligence (AI) assistants: public data on published Service Providers and their services is available to search engines and AI assistants (avatud.ee/llms.txt, MCP server), and an AI assistant can prepare a payment link for a service. The booking is always confirmed and paid for by the User personally on the Platform after logging in.

2. ACCOUNT AND AUTHENTICATION (eID)

2.1. To book or offer services, the User creates a personal account on the Platform. Browsing is possible without an account.

2.2. The account is created and accessed with an Estonian electronic identity (Smart-ID or Mobile-ID) through the authentication service eID Easy. There is no password: the User's name, personal identification code and date of birth are obtained from the eID. Confirmations given through an eID have legal effect.

2.3. The Platform may be used from the age of 18. Age is checked automatically from the personal identification code. Registration and use of the Platform by persons under 18 is prohibited.

2.4. The User confirms an e-mail address on the Platform, to which booking confirmations and other important notices are sent. Marketing messages are sent only with separate consent (section 10).

2.5. The User keeps their eID means and devices secure. All actions taken under the User's account are deemed to have been taken by the User. Suspected misuse must be reported to hello@avatud.ee.

2.6. Avatud may suspend or close an account if the User breaches the Terms, provides false information or uses the Platform for fraud. The User is notified by e-mail.

2.7. Content published on the Platform (profile, service descriptions, photos, videos) must not contain:

  • prohibited or restricted services (see the list of prohibited services);
  • contact details in service descriptions (phone number, e-mail address, social media links) — booking and payment take place through the Platform;
  • hate speech, discriminatory, violence-inciting or sexual content;
  • misleading promises of guaranteed results (health, financial gain or other benefits);
  • content that infringes third parties' copyright or other rights.

2.8. Avatud checks content automatically (including with artificial intelligence) and manually. Avatud may refuse to publish content, remove published content, and suspend or close an account; the decision is communicated by e-mail. Any User can report a Service Provider's page with the "Report this page" function.

3. SERVICE PROVIDERS AND PLANS

3.1. A Service Provider is a User who has completed seller registration on the Platform (as a private individual or a company; company data is verified against the Estonian Business Register) and accepted the Service Provider Agreement.

3.2. Free plan: the Service Provider's public page, visible on the Platform, to search engines and to AI assistants. The page is published for 30 days from registration; visibility can be extended by 30 days by tagging Avatud on Instagram or Facebook as described on the Platform. Services cannot be sold on the Free plan.

3.3. Paid plan: in addition to the page, a service shop, a portfolio and card payments. The monthly fee is published on the Platform (€29.90 per month when these Terms enter into force) and is paid in advance through Stripe. The subscription renews automatically every month until the Service Provider cancels it in the dashboard (Subscription); cancellation takes effect at the end of the paid period and the fee for the current period is not refunded.

3.4. When the Paid plan ends, the shop and portfolio become unavailable; the page remains visible under the Free plan terms. Bookings already paid for are completed under their original terms.

4. BOOKING AND ACTIVATION CODE

4.1. Service information (description, price, location, duration, service type) is prepared by the Service Provider. Avatud performs spot checks, but the Service Provider is responsible for the accuracy of the information.

4.2. Prices are in euros and are final for the Client: if the Service Provider is VAT-registered, the price includes VAT. Avatud adds no additional fees for the Client. When a discounted price is shown, the reference price is the lowest price at which the Service Provider has offered the same service during the previous 30 days.

4.3. To book, the Client selects a service, for scheduled services also a date and time, and pays by card. The service contract is concluded between the Client and the Service Provider and is deemed concluded when Avatud has received the payment confirmation. The Client receives a confirmation by e-mail; bookings are visible in the dashboard (Orders).

4.4. Activation Code: for a booking of a scheduled service (types FLEXIBLE and STRICT) the Platform generates a unique 6-digit code, shown in the Client's account. The Client presents the code at the start of the service and the Service Provider enters it in their sales panel — this confirms that the service was delivered. The code is not sent by e-mail and must not be shared before the service starts. INSTANT services have no code (clause 7.7).

4.5. In the event of a pricing error, where the price published on the Platform is materially lower than the market price of the service due to a technical error, Avatud has the right to withdraw from the sale. The Client is refunded the full amount paid.

5. PAYMENTS

5.1. Payments are processed by the payment service provider Stripe Payments Europe, Ltd. (Stripe). The Client pays by bank card (Visa, Mastercard and others; Apple Pay or Google Pay where the device supports them). Card details are entered in Stripe's secure form and never reach Avatud. By making a payment the Client agrees to Stripe's terms.

5.2. The Client's payment obligation towards the Service Provider is deemed fulfilled from the moment the payment has reached Avatud as agent, regardless of when Avatud transfers the amount to the Service Provider.

5.3. Avatud holds the payment until the service is completed and then transfers it to the Service Provider. The Service Provider may not demand an additional payment from the Client or refuse to provide the service when the Client has a valid Activation Code.

5.4. Avatud charges no commission on transactions. Stripe's card processing fee is borne by the Service Provider. The Client pays exactly the price shown on the Platform.

5.5. Refunds are made through Stripe to the same payment method that was used for the payment, as a rule within 5–10 business days depending on the bank. The full amount paid is refunded.

6. USE OF ARTIFICIAL INTELLIGENCE

6.1. The Platform uses artificial intelligence in search (understanding the query, matching services and Service Providers), in checking new services against the Platform's rules, and in summarising reviews. The processing is performed by OpenAI; details are in the Privacy Policy.

6.2. AI-generated content is informational. Avatud does not guarantee its complete accuracy; a search result is not a recommendation of a specific Service Provider.

6.3. The User assesses AI suggestions critically, especially in matters of health and well-being. AI suggestions do not replace professional advice.

6.4. Third-party AI assistants (clause 1.5) use the Platform's public data. Avatud is not responsible for how a third party's assistant presents that data. The binding information is what is shown on the Platform at the time of booking.

7. CANCELLATION AND RIGHT OF WITHDRAWAL

7.1. The service type is shown on the service page before purchase and determines the cancellation procedure.

7.2. Type FLEXIBLE (flexible scheduled service): the Client can cancel the booking in their account (Orders → cancel) within 14 days of purchase, but no later than the start of the service — whichever comes first. On cancellation the full amount paid is refunded. This is the consumer's 14-day right of withdrawal (VÕS § 56); the standard form is here, and cancelling in the account is equivalent to submitting the form. After the deadline the booking cannot be cancelled.

7.3. Type STRICT (service with a fixed date and time, e.g. a workshop, course, event or specific appointment): there is no right of withdrawal (VÕS § 53⁴ p 12) and the Client cannot cancel the booking. The purchase is final.

7.4. Type INSTANT (online service delivered immediately after purchase, e.g. a recorded course, materials, access to an online environment): by paying, the Client agrees that delivery of the service starts immediately and acknowledges that they thereby lose the right of withdrawal (VÕS § 53⁴ p 11). The Client cannot cancel the booking.

7.5. Cancellation by the Service Provider: the Service Provider may cancel a booking before the start of the service (for INSTANT, before providing access). In that case the Client is automatically refunded the full amount paid.

7.6. Activation and no-show (FLEXIBLE and STRICT):

  • Entering the Activation Code confirms that the service was delivered and the booking is deemed completed (Completed).
  • If the code is not entered within 24 hours from the start time of the service, the outcome is determined by which party reported a no-show: if the Service Provider reported that the Client did not show up, the service is deemed delivered and the Service Provider is paid; if the Client reported that the Service Provider did not show up, the Client is refunded in full; if both parties reported, or neither did, the Client is refunded in full.
  • A no-show can be reported in the account from 15 minutes after the start time until 24 hours after it.

7.7. Type INSTANT: the Service Provider sends the access information to the Client's account. If access is not provided within 24 hours of payment, the booking is cancelled automatically and the money is refunded. After access is provided, the service is deemed completed once both parties have left a review or after 72 hours.

7.8. The right of withdrawal does not apply where the Client is a legal person or purchases the service in the course of economic or professional activity (B2B).

8. COMPLAINTS, REVIEWS AND DISPUTES

8.1. Avatud is responsible for the technical functioning of the Platform, the validity of the Activation Code and the payment process. The Service Provider is responsible for the content and quality of the service.

8.2. Complaints are submitted to hello@avatud.ee; Avatud replies within 15 days. A consumer may turn to the Consumer Disputes Committee (komisjon.ee) or the EU online dispute resolution platform (ec.europa.eu/consumers/odr). Court disputes are settled in Harju County Court.

8.3. After the service is completed, both parties can leave a review. A review must be truthful and based on actual experience; Avatud may remove a review that violates the Terms.

9. DEFECTIVE SERVICE AND RIGHT TO CLAIM

9.1. A consumer Client has the right to submit a claim regarding the non-conformity of the service with the contract within two (2) years from the provision of the service (VÕS § 218). A defect that becomes apparent within the first year is presumed to have existed at the time of provision; the Service Provider must prove otherwise.

9.2. The Client notifies of the defect within a reasonable time, but no later than two (2) months after discovering it, by sending a notice to hello@avatud.ee.

9.3. Avatud responds to the claim in a form that can be reproduced in writing within fifteen (15) days.

9.4. If the defect is the Service Provider's responsibility and cannot be remedied (including by replacement or re-performance), the Client is refunded the full amount paid under the contract.

10. DIRECT MARKETING

10.1. Avatud sends marketing messages to the User's e-mail address only if the User has given prior explicit consent.

10.2. Consent can be withdrawn at any time via the unsubscribe link in each marketing message or by sending a notice to hello@avatud.ee.

10.3. Transactional notices (booking confirmation, reminders, refund, order status change, review invitation, plan expiry reminder, security notices) are not marketing messages and are sent for the performance of the contract regardless of marketing consent.

11. PERSONAL DATA AND COOKIES

11.1. The principles of personal data processing are set out in the Privacy Policy and the use of cookies in the Cookie Policy. They form an integral part of the Terms.

12. ACCOUNT DELETION AND TERMINATION

12.1. The User can delete their account in the dashboard (Profile). Deletion has a 30-day waiting period during which the request can be cancelled by logging in; after that the account is deleted. Transaction and accounting data are retained in anonymised form for the period required by law.

12.2. Deleting the account does not cancel existing bookings or payment obligations. Before deletion the User completes or cancels their bookings; a Service Provider's paid bookings are completed or refunded to the Clients.

13. AMENDMENTS AND FINAL PROVISIONS

13.1. Avatud may amend the Terms. The new version is published on the Platform with its effective date; Users are notified of material changes by e-mail at least 14 days in advance. Continued use of the Platform after the effective date constitutes acceptance of the changes.

13.2. The Terms are governed by the law of the Republic of Estonia. The Terms do not limit the consumer's statutory rights.

13.3. The Terms are published in Estonian, English and Russian. In case of discrepancy, the Estonian text prevails.
